Terms and Conditions
Terms and conditions apply to all clients unless otherwise stated.
Cancellation Fee
We kindly request that you give us at least 24 hours' notice to cancel or reschedule any job that has been scheduled in advance. If a crew has been dispatched to the job site after cancellation, you may be charged a $125 mobilization fee due to incurred expenses to us.
Inaccessibility Fee
If we cannot perform the service due to a locked gate, dog outside, another contractor performing services that restrict us from performing our services, etc., you may be charged a $125 fee.
Credit Card Fee
Credit card payments will have a mandatory 3% processing fee when paid manually by the client or if the client has a card on file.
Card Drafting & Timing
All card payments must be completed before services are rendered. Payments processed after the specified time may result in delays to the project timeline.
Call Ahead
If requested, we will notify you via email, call, and/or text at least 24 hours before a service is performed.
Project Rescheduling
LandGreen Landscaping Inc. reserves the right to reschedule a job due to factors including, but not limited to, weather conditions, equipment problems, labor shortages, unforeseen tragedies, or supply chain issues. We will contact the client as soon as possible to reschedule the project.
Use of Subcontractors
Upon acceptance of any project, the client agrees that LandGreen Landscaping Inc. has the right to use subcontractors as needed to complete the job efficiently and professionally.
Tools and Materials Removal Clause
LandGreen Landscaping Inc. reserves the right to access the property to remove all tools, equipment, and materials from the job site until full and final payment has been received. This includes any partial payments made throughout the project. Failure to provide final payment upon completion of the work will result in the immediate suspension of all services, and tools and materials may be reclaimed without further notice until the balance is paid in full.
Media Release
Often, we take pictures and/or record videos while performing certain services/jobs. We may use these pictures/videos for training and promotional purposes. We will not release or show any personal information/identity unless approval from the client is granted.
Upon acceptance, clients give us the right to use, publish, and reproduce pictures, video, and sound recordings in any and all media formats for any and all purposes. In addition, the authorizing party waives the right to receive any payment from LandGreen Landscaping Inc. for the use of this media.
Clients Pay Court Fees
If legal action is necessary to resolve any disputes arising from the services provided, the client agrees to cover all associated court fees and legal costs incurred by LandGreen Landscaping Inc.
Stormwater Damage
LandGreen Landscaping Inc. is not responsible for any stormwater damage to the property, including but not limited to flooding, soil erosion, water runoff, or any structural damage caused by improper drainage. The client is responsible for ensuring proper stormwater management on the property, including any necessary permits, inspections, or corrective measures. By signing this agreement, the client acknowledges that LandGreen Landscaping Inc. will not be held liable for any damages resulting from inadequate stormwater management or drainage issues.
Clients are advised to consult a licensed stormwater management professional to assess and implement appropriate measures (Retention Ponds, Swales, etc…) for stormwater control on their property. LandGreen Landscaping's Inc. services focus on landscaping and horticultural work, and while we may install basic drainage features like grading or French drains, these are not intended to function as full stormwater management systems.
Holiday Decorations Cancellation
LandGreen Landscaping Inc. is not responsible for the installation, removal, or maintenance of any holiday decorations on the property. If the amount of holiday decor exceeds a reasonable amount, as determined by the landscaper, an additional fee will be charged. The client is responsible for removing all holiday decorations from the property before the scheduled landscaping services. Failure to do so may result in a delay of services or additional charges. The landscaper is not liable for any damage to holiday decorations that may occur during landscaping services.
Access to Utilities
During our work, the client is required to provide access to both electricity and water on the property. It is the client’s responsibility to ensure that these utilities are available for use by our team throughout the project.
If the client does not provide access to the necessary utilities (electricity and water), it may result in delays to the project or additional costs. In such cases, LandGreen Landscaping Inc. reserves the right to:
Delay or suspend work until access to the required utilities is provided.
Charge additional fees for any delays or for sourcing alternative water or power solutions, if required.
Extend the project timeline to accommodate for any interruptions caused by the lack of access to utilities.
LandGreen Landscaping Inc. will not be responsible for any associated utility costs.
Cancellation Clause Regarding Deposits
Deposits made for services are non-refundable. If a client requests to cancel their service, they may do so up to fourteen days before the scheduled start date for a credit toward future services. Cancellations made after this timeframe will forfeit the deposit.
Right to Notice of Lien
LandGreen Landscaping Inc. reserves the right to file a lien against the property for any unpaid balances related to services rendered. If the client fails to make payment in full according to the agreed-upon terms, a notice of lien may be filed to secure the outstanding balance. The client will be notified in writing before a lien is placed on the property.
This lien will remain in effect until the balance is fully paid, including any applicable interest, fees, or legal costs associated with recovering the payment.
Landscape Services
Damage to Underground Utilities
LandGreen Landscaping Inc. is not responsible for damage to underground utilities, including but not limited to cable, phone, water, communications, or sewer lines. We will contact 811 before starting any digging and take necessary precautions to avoid marked utilities.
Client Responsibility for Marking Additional Utilities
The client is responsible for marking any irrigation heads, piping, drainage systems, sewer lines, landscape/outdoor lighting, electric dog fencing, and other underground utilities not marked by 811. If any unmarked utilities are damaged, the client will be billed directly. LandGreen Landscaping Inc. is not responsible for repairing any utilities that were not properly marked beforehand.
Deposit Policy for Landscaping Projects
For landscape jobs over $1,000, a 50% deposit is required before scheduling. This deposit will be applied to the total balance upon project completion. Final payment is collected after the job is completed.
For jobs exceeding $20,000, the payment schedule will be as follows:
50% upfront before the start of the project
25% at the halfway point of the project
The remaining 25% upon completion
Obstacles and Unidentified Objects
If unidentifiable underground objects, such as stumps, boulders, rocks, concrete, or utilities, are encountered and hinder the project’s scope of work or completion, LandGreen Landscaping Inc. will notify the client as soon as possible. While we strive to predict potential challenges, unforeseen underground obstacles are out of our control, and LandGreen Landscaping Inc. is not responsible for delays or adjustments caused by them.
Client Satisfaction and Issue Resolution
If a client is unsatisfied with the work, they must notify LandGreen Landscaping Inc. in writing within 24 hours of project completion. Any issues reported after 24 hours may not be addressed, and LandGreen Landscaping Inc. reserves the right to decline further changes after this period.
Change Order Payment Policy
In the event of an approved change order, the client must pay the full amount of the change order upfront before the additional work is completed. Failure to provide payment may result in delays or suspension of the work related to the change order.
Payment
We will invoice you via email, text, or in person after services are completed. Payment is due within 15 days of job completion and/or invoice date.
Past-due invoices will accrue an interest rate of 8% per month, with a minimum charge of $15.
If your account is past due, we may pause your services and require a credit card on file to restart your account.
Flagstone
Due to the nature of flagstone, stones can vary greatly leading to slight wobbling, cracking, and settling. Flagstones won't be the same size and shape. No warranty on flagstone is provided by LandGreen Landscaping Inc. nor the manufacturer.
Excess Material
LandGreen Landscaping Inc. owns all materials used on any job site and any excess materials are up to the discretion of LandGreen Landscaping Inc. Extra material will not be left on site upon completion unless specified in writing with the client.
Plant Designs
Upon completion of plant designs, revisions can be made for $100 per change.
Planting Warranty
We guarantee that we offer healthy and high-quality plants upon installation. Plants are not covered under warranty if they are damaged by human or vehicle interference, extreme weather conditions (frost, freezing, etc.), damage from animals, insects, or pests (dogs, deer, rabbits, etc.), lack of water or overwatering, natural disasters like hurricanes, storms, severe weather, tornadoes or other reasons. The client is responsible for notifying us if a plant shows any signs. We will then inspect the plant and take measures to save or replace it.
LandGreen Landscaping Inc. and our suppliers will not warranty any plants or sod unless otherwise specified in writing to the client. We are also not responsible for the watering of any installed plants or sod unless otherwise stated by the client or LandGreen Landscaping Inc. in writing. We ensure that all plants, sod, or materials will be sourced from quality and trusted suppliers and that they will be planted properly.
Plant, Sod, and Material Pricing
Plant, sod, or material pricing is based on current inventory and pricing at the time of the estimate. Plant, sod, and material availability is subject to change. If we need to adjust pricing, plant size, or actual plants, sod, or materials, we will keep you informed.
Seeding & Compost
We do not offer a warranty on seed or compost. We can guarantee that the service will be properly installed and that the quality provided is high. Once the seed or compost is installed, it is your responsibility to keep it alive through watering and regular monitoring.
LandGreen Landscaping Inc. or suppliers do not warranty or promise any additional seed or compost needed due to animal/human damage, natural disasters, or lack of water or overwatering. Additional seed and compost are available at an additional cost billed to the client.
Machinery
By accepting our proposal, you grant us access to the property with any machinery that we may need on all job sites. LandGreen Landscaping Inc. is not responsible for any tire or track marks left during the job unless otherwise specified by the client or LandGreen Landscaping Inc. We promise to take every measure possible to avoid these circumstances to the best of our ability.
Maintenance Services
Damage to Underground Utilities
We are not responsible for damage to underground or above-ground utilities that are not properly marked or that we are not notified about in writing. You are responsible for marking any irrigation heads, piping, drainage, sewer, and/or wiring that is underground.
Payment
We will invoice you via email, text, or in person at the beginning of each month. Payment is due within 21 days of the invoice date. If your account is 21 days past due, we may pause your services.
Past-due invoices will accrue an interest rate of 8% per month, with a minimum charge of $15.
Overgrowth Fee
If your account is paused and it takes longer to mow your grass, due to overgrowth, we may charge more for the time spent servicing your property.
Leaf Cleanup
During leaf cleanups, we do our best to remove or diminish any leaves standing in our way. We are not responsible for any additional leaves that fall after cleanup unless stated in writing by the client or LandGreen Landscaping Inc.
Personal Item Removal
Our maintenance crew is not responsible for picking up trash, dog/kid toys, or any materials/tools left by the client before the service unless written in the contract.
Weed Control Acknowledgement
While our treatments are designed to reduce weed presence, we cannot guarantee a completely weed-free lawn. Weed management is a continuous process where timing is essential. If treatments are started mid-season, it will impact the effectiveness of weed control.
Client Responsibility for Self-Performed Work
If the client chooses to perform any work themselves during the project, LandGreen Landscaping Inc. will not be held liable for any issues, damages, delays, or disruptions resulting from the client’s actions. The client assumes full responsibility for the quality and outcomes of their work and any consequences. Additionally, if the client’s work interferes with or negatively impacts our services, they will be held responsible for any resulting setbacks or damage to the project.
Once a contract has been signed, the agreed-upon pricing is final. If the client chooses to complete any portion of the work themselves after the contract is signed, no discount or price adjustment will be provided. The total cost of the project will remain as originally stated in the contract, regardless of any work completed by the client.
